ELIGIBILITY: The Kitchen Scraps Fan Favorite Giveaway (“Giveaway”) is open to individuals who are legal residents of the 50 United States (“Territory”) and age 21 or older at time of entry collection. Employees of Sponsor, Administrator, or their respective parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”) are not eligible to enter or win; nor members of their households or immediate families (defined as parent, child, siblings and the spouses of each). Giveaway is governed by and subject to all applicable U.S. federal, state and local laws and regulations. Void where prohibited by law.
SPONSOR: Hawaii Food & Wine Festival, 3538 Waialae Ave. #202, Honolulu, HI 96816 (“Sponsor”).
ADMINISTRATOR: Hawaii News Now, 420 Waiakamilo Rd. #205, Honolulu, HI 96817 whose decisions are final and binding with respect to the Giveaway.
HOW TO ENTER: Visit https://www.hawaiinewsnow.com/page/kitchen-scraps-fan-favorite/ and follow all online instructions to submit the Giveaway entry form (“Entry”) located on the website. All Entries must be received between 12:00 A.M. Hawaii Standard Time (“HST”) on January 12, 2025 and 11:59 P.M. HST on Sunday May 11, 2025 (the “Giveaway Entry Period”). Limit: one (1) Entry per person/email address per day. All Entries and requests become the property of Sponsor and Administrator and will not be acknowledged or returned. It is your sole responsibility to notify the Administrator if you change your email address (“Address”).
LIMITATIONS: All Entries must be received by 11:59 P.M. HST. Sunday, May 11, 2025. Entries are limited to one (1) Entry per person/Address per day (regardless of method of Entry or whether one person has more than one Address or more than one person uses the same Address). In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 6 are void. Any use of automated or programmed methods effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server, Internet Service Provider, Website or other connections, telephone or cell phone text messaging availability or accessibility; miscommunications; failed computer, satellite, telephone or cable transmissions, lines or technical failure; failed phone, computer hardware or software or text message malfunctions, failures, technical errors or difficulties; telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple Addresses or cell phone accounts to register more than the number of Entries allowed by these Rules may result in disqualification at Administrator’s sole discretion. Void where prohibited or restricted by law and subject to all applicable U.S. federal, state, local and municipal laws and regulations.
PRIZE: Two (2) General Admission Tickets to one (1) 2025 Fifteenth Annual Hawaii Food & Wine Festival event on Oahu during October 30 and November 2, 2025 (“Prize”). Event is to be determined and approximate retail value of the Prize will be between $250 and $600 USD. Prize cannot be transferred, exchanged or replaced and has no cash value whatsoever. Other restrictions and fees may apply. Arrangements for the fulfillment of the Prize will be made by Sponsor and/or its designated agent. Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. Event tickets are not for sale. Winner and guest must comply with any security procedure or measures imposed by the Event and/or its representatives who reserve the right in their sole discretion to suspend or cancel the participation of any winner or guest due to non-compliance with any security procedure or inappropriate behavior or misconduct. If the Event is canceled, postponed, or cannot be fulfilled due to circumstances beyond the Sponsor’s control, the Sponsor reserves the right to modify or cancel the prize without further compensation to the Winner. All fees, federal, state, local or other expenses relating to the use, acceptance and possession of prize are the sole responsibility of the Winner. Taxes are the responsibility of the Winner. An IRS form 1099 will be filed in the name of the Winner for the retail value of the prize for $600 or above. The retail value of the prize has been determined by the participating partners at the time of the Giveaway announcement and cannot be modified. Odds of winning depend on eligible Entry received during the Giveaway Entry Period.
RANDOM DRAWING: Winner will be determined in a random drawing from all eligible Entries received during Giveaway Period by Administrator whose decisions are final and binding in all matters relating to this Giveaway. Winner will be notified by e-mail and/or mail (“Notification”) on or around May 18, 2025 by Administrator. Winners will be required to complete, sign and return an Affidavit of Eligibility, Liability and Publicity Release (collectively, “Release”) within five (5) days of date specified on notification. If a potential prize winner does not acknowledge receiving the notification within 48 hours of its dispatch, or does not return the executed Release within five (5) days, or if said e-mail and/or mail is returned as undeliverable, or if an entrant is otherwise found to be ineligible, or if the selected winner cannot accept or receive the Prize for any reason, the potential prize winner will forfeit the Prize and an alternate winner will be selected. The Sponsor and Administrator reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any. Entry and acceptance of Prize constitutes permission (except where prohibited by law) to use winner’s name, prize won, hometown and likeness for online posting and promotional purposes without further compensation.
LIMITATION OF LIABILITY: By entering you agree to release and hold harmless Sponsor, Administrator, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries; (vi) the creation of an entry including any and all claims for copyright infringement, invasion of privacy, violation of the right of publicity or defamation; (vii) the acceptance, possession, use or misuse of the prize or parts thereof, if applicable, or participation in the contest or participation in any contest or related activity.
CONDITIONS: By entering this Giveaway and/or accepting any prize you may win, you agree that: (i) you have all rights, permissions and consents necessary to grant the rights to Sponsor and Administrator as expressed herein; (ii) you will abide by and be bound by the Rules and the Sponsor and Administrator’s decisions; (iii) the Entry becomes solely the Sponsor and Administrator’s property and will not be acknowledged or returned;(iv) you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Giveaway or any Giveaway-related activity or travel or from any interaction with, or downloading of, computer Giveaway information; (v) the prizes are awarded AS IS and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); neither Sponsor nor the Administrator or Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Giveaway or Prize; (vi) a winner’s acceptance of the Prize grants and assigns the Sponsor and Administrator an unconditional right to use the winner’s name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the Giveaway for any programming, publicity, advertising and promotional purposes, worldwide, in perpetuity, without additional compensation, except where prohibited by law; (vii) in the event of viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor and Administrator’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Giveaway, so that it cannot be conducted as originally planned, except where prohibited by law, the Administrator has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Giveaway; and in such event, to select a winner by such method as Administrator in its sole discretion shall consider equitable and in the event the Prize has already commenced, to terminate the Prize and return the Winner and guest to any airport of origin as soon as reasonably possible; (viii) the Releasees are not responsible for typographical or other errors in the offer or administration of this Giveaway, including but not limited to: errors in the advertising, Rules, selection and announcement of the winner and distribution of the prize; (ix) any portion of any prize not accepted or used by a winner will be forfeited; (x) the Releasees are not responsible for any inability of a Winner to accept or use the prize (or any portion thereof) for any reason; (xi) the Administrator has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Giveaway or the Entry process; (b) violating the Rules and Conditions; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Giveaway property or service; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the Administrator; (xii) Administrator has the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Giveaway; (xiii) since any attempt by any individual to damage the Entry process or undermine the legitimate operation of this Giveaway or the Entry website is a violation of these Rules as well as criminal and civil laws, and should Administrator believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution; (xiv) all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Giveaway, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of Hawaii, without regard to conflict of law provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state; (xv) all Claims shall be resolved individually, without resort to any form of class action; (xvi) all Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased; (xvii) Administrator has the right to modify prize award procedures at its sole discretion.
PRIVACY: By entering, entrants agree to be subscribed to Sponsor and Administrator’s mailing list(s) to receive periodic email newsletter updates and marketing promotions. However, information entrants provide will not be sold or shared with Sponsor or Administrator’s partners or any 3rd party, except for participating prize partners.
